eBuddy takes your privacy seriously and will process and use information about you in a secure manner. Therefore eBuddy has established and implemented this Privacy Statement in which we describe what information we collect about you and how we use it. We therefore recommend that you read this Privacy Statement carefully.

1. What is eBuddy?

eBuddy is an online web based messenger that allows you to chat online anytime and everywhere. eBuddy's mobile products allows you to chat anytime, everywhere on your mobile phone; additional charges may apply depending on product version and operator subscriptions. eBuddy is established at Keizersgracht 585 in (1017 DR) Amsterdam and is listed at the Chamber of Commerce under number 34211186. The manner in which your personal details are saved and used has been reported to the Dutch Data Protection Authority.

2. What information is collected and processed by eBuddy?

Use without eBuddy ID

When you use eBuddy without creating an eBuddy ID, you provide us with your user name and password. We use your password only to log you in to the IM network and do not store it. We might also ask you to provide your age and gender, but this is not obligatory.

Use with eBuddy ID

In order to make optimum use of eBuddy you have to create a personal account: the eBuddy ID. When creating such eBuddy ID you provide eBuddy with certain information, such as your eBuddy ID log-in, password, gender, age, and e-mail address. We also store the account credentials for all accounts associated with your eBuddy ID (network, user name and password). These account credentials are stored encrypted. You can always adjust the information you have provided.

Automatically Generated Information

eBuddy also collects automatically generated information about your behaviour during your use of the Service. This information consists, for instance, of your IP address (number of your computer making it possible to recognise your computer), the browser type (computer program to enable the viewing of internet pages) that you use, what features you use and for how long, browser settings and other information regarding your session, "cookies" and the type of hand held device you use to access eBuddy for mobile devices (we do not store your telephone number).

Furthermore, we also store some of the information that is uploaded by you when using eBuddy, such as pictures you send through eBuddy, your own display picture, the display pictures of your buddies and customized emoticons.

Cookies

Like many websites, eBuddy employs "cookies" to allow us to provide information which is targeted to your interests and to make your experience of eBuddy more convenient. Cookies are small bits of electronic information that a website sends to a visitor's browser and/or hand held device and are stored on the visitor's hard drive and/or hand held device.
We use cookies for the following purposes:

• to store a user's eBuddy ID log-in identity so that your session won't expire unless you actively log out;
• to store a user's eBuddy ID log-in identity so that the log-in box is already filled in upon your next use of eBuddy; Please be advised that we do not store your password.
• to serve you relevant advertisements based on non-personal information such as your age and gender and also to ensure you will not be served the same advertisement too often; and
• to ensure that the eBuddy service is protected.

You may refuse the use of cookies by selecting the appropriate settings on your browser and/or hand held device, however, if you do this, you may not be able to use the full functionality of eBuddy.

If you do make use of cookies, make sure that you log out if you leave a public computer. Also keep your password secret in order to avoid others using your eBuddy ID without your consent.

3. For what purposes will eBuddy use information about you?

Purposes

eBuddy will use information about you for the following purposes:

• to enable you to use eBuddy and make your experience more convenient;
• to send information to you about eBuddy's own, similar services, inter alia, promotional actions of eBuddy;
• to draw up statistical and demographic data rendered anonymous and used for performance monitoring;
• to serve you relevant advertising based on non-personal information and to prevent that you are presented with the same advertisements too often;
• to provide your information to third parties only if you have given your explicit prior consent;
• to provide your information to third parties pursuant to legal obligations.

Use by eBuddy

As a general matter, we use the information you provide to us to process your eBuddy ID registration, and to provide eBuddy to you. We will also try to enhance and personalize your use of eBuddy based on the information you provided.

In addition eBuddy wants to keep you informed of the development of the eBuddy service. If an expansion is on its way or an update or new functionalities are created, eBuddy will inform you of this. eBuddy can also keep you informed of the actions it organises. We may also ask you to participate in surveys in order to help us make eBuddy better. Once in a while you can expect a message from eBuddy in this respect. If you do not want to receive any messages about the Service, you can unsubscribe via this Internet address: http://www.ebuddy.com/unsubscribe.php. In addition, each individual message includes the possibility to unsubscribe. Please do keep a close eye on the eBuddy website so that you know when there is a new update or expansion. Please be advised that you cannot unsubscribe from certain correspondence from us, including messages relating to your eBuddy ID.

eBuddy also offers you advertisements that it thinks are interesting to you based on your age and gender. eBuddy only uses your age and gender to offer you these relevant advertisements, no personal data are used. Please be advised that we will not transfer any personal information to the third parties that offer you relevant advertisements.

eBuddy uses the automatically generated information for statistical purposes which allows it, inter alia, to monitor performance of eBuddy and to trace down possible problems. These details can be provided to third parties insofar as they cannot be traced back to you personally (no personal details).

Use by third parties

Without your explicit consent eBuddy will not sell or rent your personal details to any third parties for direct marketing purposes (for instance for sending advertisements). eBuddy can, however, provide your details to third parties insofar as this is necessary for the provision of eBuddy to you and/or insofar as these details cannot be traced back to you personally (such as Automatically Generated Information excluding your IP address). Please be advised that eBuddy never shares eBuddy ID log-ins and/or passwords. Finally, eBuddy can provide your details to third parties if it is obliged to do so pursuant to legal provisions, it is forced to do so as a result of a legal case and/or in the event that it regards it as necessary for the protection of its own rights.

If you circulate information about yourself via eBuddy you should take into account that these details can be read and used by the persons you are chatting with. Therefore, please take care when providing personal information via eBuddy.

Google Analytics

eBuddy uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of eBuddy (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of eBuddy, compiling reports on eBuddy activity for us and providing other services relating to eBuddy activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. Google's use of this data is governed by the Google Analytics Terms of Service (http://www.google.com/analytics/tos.html) and Privacy Policy (http://www.google.com/privacy.html).

4. In what manner does eBuddy protect your personal information?

eBuddy will take suitable technical and organisational measures to protect your (personal) details against loss or against any form of unlawful processing.

5. Transfer of company

In the event of a further growth and development of eBuddy it may be that one or more parts of the assets of the company are transferred to a third party or that eBuddy merges with a third party. In that case your (personal) details will also be transferred.

6. Transfer to countries outside the EU

It may be required for technical and operational reasons that your (personal) details are transferred to (servers of) companies affiliated to us in the United States or other countries outside the European Union where the regulations in the field of privacy protection might not provide the same protection as in the European Union. By using the Service you are giving your consent to this. Notwithstanding the above, eBuddy will use reasonable endeavours to ensure that the necessary measures and relevant controls are in place in order to protect the confidentiality and security of your (personal) data.

You can always view your own (personal) details and if necessary change them in your account. If you want to know which details eBuddy has recorded about you or if you want to change details which you cannot change in your account, you can contact our customer service via privacy@ebuddy.com

8. What is the scope of eBuddy's responsibility?

The eBuddy service may contain hyperlinks or hyperlinks may be offered to you by other user, by which you leave eBuddy and end up on the websites of third parties. eBuddy has no power over the websites of third parties to which you are linked. It may therefore be the case that a different privacy policy is applicable to the use of these websites of third parties. This Privacy Statement only relates to (personal) details which have been obtained via the use of eBuddy. eBuddy does not accept any responsibility or liability for (the operation and/or contents of) websites of third parties.

Via eBuddy you can share information about yourself with others. You yourself are responsible for the personal information which you spread via eBuddy. eBuddy does not accept any responsibility or liability for this.

9. Are minors allowed to use eBuddy?

In principle everybody can use eBuddy and everybody can create an account. However, it is important that special legal rules apply to persons who are not yet sixteen (16). If you are not yet sixteen (16) you are required to obtain the consent of your parents or guardian before you create an account. If you are below the age of 16 and you don't have this consent, you are not allowed to use eBuddy.

This Privacy Statement can be changed. The changed Privacy Statement will be communicated to you in a manner chosen by eBuddy.
